美國(guó)聯(lián)邦法院裁定中興通訊盜用美國(guó)公司EDA軟件的指控成立
美國(guó)聯(lián)邦法院裁定日前中國(guó)中興通訊(ZTE)對(duì)其雇員非法盜用美國(guó)公司EDA軟件一案負(fù)有責(zé)任。該款高頻電子設(shè)計(jì)輔助軟件是美國(guó)AWR公司的產(chǎn)品,AWR通過(guò)軟件內(nèi)建的用戶數(shù)據(jù)跟蹤系統(tǒng)發(fā)現(xiàn)中興通訊的員工使用了非法的軟件密碼,同時(shí)又在線接受了“軟件使用許可協(xié)議”,從而構(gòu)成了對(duì)軟件的非法盜用。法院同時(shí)還駁回了中興通訊有關(guān)
“該軟件使用許可協(xié)議和中興通訊無(wú)關(guān)”的申訴。
AWR是在去年就本案對(duì)中興通訊及其在美國(guó)的子公司提起訴訟的,訴訟指控中興通訊安裝了AWR公司未經(jīng)授權(quán)的的EDA軟件。
Court finds for AWR over ZTE in piracy case
SAN FRANCISCO--A U.S. federal court ruled Monday (June 13) that China’s ZTE Corp. is liable for its employees using an unauthorized key code to access and use software marketed by high-frequency EDA vendor AWR Corp.
Relying on data AWR gathered through a “phone home” feature of its software, the U.S. District Court for the Central District of California found that ZTE employees had accepted AWR’s click-through license agreement. The court also rejected ZTE’s claim that it was not bound by that agreement.
In a landmark case, AWR last year filed compaint against ZTE and its U.S. affiliate, alleging that ZTE installed and used unauthorized versions of AWR's EDA software. A hearing on AWR’s remaining claims and on damages is set to begin Aug. 9.
